By accessing and using Lifelogging.AI (the "Application"), you represent that you have read, understood, and agreed to comply with and be bound by these Terms of Service. If you do not agree, you may not use the Application. Use of the Application constitutes a legally binding agreement between you and the operators of Lifelogging.AI.
The Application provides journaling analysis services through AI technology. These services include analyzing personal journal entries to generate insights.
Lifelogging.AI employs commercially reasonable, industry-standard security measures to protect user data. However, no method of transmission over the internet or method of electronic storage is 100% secure. By using this service, you expressly acknowledge and accept these inherent risks.
You agree not to upload, transmit, or store sensitive personal information—including but not limited to financial data, government-issued identification numbers, medical records, or confidential business data—unless you voluntarily assume all risks and consequences associated with potential data breaches or unauthorized disclosures. You further agree that it is your sole responsibility to delete such information after processing. You acknowledge that Lifelogging.AI includes automated systems to delete inactive user data after a period of inactivity, but that this is provided as a courtesy and does not relieve you of responsibility for managing your data.
By registering for and using this service, you expressly waive, release, and hold harmless Lifelogging.AI, including its operators, developers, contractors, and affiliates, from any and all claims, liabilities, damages, losses, or expenses—whether direct, indirect, incidental, consequential, or otherwise—arising from unauthorized access, data breaches, cyberattacks, or other security incidents, even if resulting from acts of negligence, provided such negligence is not gross or willful.
The content and features of the Application are the property of Lifelogging.AI and are protected by intellectual property laws.
Users retain ownership of the journal entries they submit to the service. For details on how user data is handled, please refer to our Privacy Policy.
The Application provides AI-generated insights based on user-submitted journal entries. These insights are provided "as-is" and are not guaranteed to be accurate, complete, or reliable. Lifelogging.AI is not liable for any decisions, actions, or consequences resulting from the use of these AI-generated insights, or for any harm caused by security incidents, including data loss or cyberattacks, to the fullest extent permitted by applicable law.
Users agree to indemnify and hold harmless Lifelogging.AI and its operators, developers, contractors, affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Application, your violation of the Terms, or your violation of any rights of another.
Lifelogging.AI reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We are not liable to users or any third party for any modification, price change, suspension, or discontinuance of the service.
Mediation. In the event of any dispute, claim, or controversy arising out of or relating to these Terms of Service, or the breach, termination, enforcement, interpretation, or validity thereof ("Dispute"), you and Lifelogging.AI agree to first attempt to resolve the Dispute through mediation.
Mediation Process. The mediation will be conducted remotely or in a location selected by the operator of Lifelogging.AI within the State of California, by a mediator chosen by the parties or, if the parties cannot agree, appointed by the American Arbitration Association ("AAA"). The mediation will be conducted in accordance with the AAA's Commercial Mediation Procedures. The costs of mediation will be paid by the party raising the dispute.
Arbitration. If the Dispute is not resolved through mediation within 30 days of the commencement of mediation, or if either party refuses to participate in mediation, the Dispute will be resolved by binding arbitration in accordance with the AAA's Commercial Arbitration Rules. The arbitration will be conducted in San Jose, California before a single arbitrator appointed in accordance with the AAA's rules. The arbitrator shall not award punitive damages unless explicitly authorized by applicable law. The arbitrator's decision will be final and binding on the parties, and judgment on the award may be entered in any court of competent jurisdiction.
Waiver of Jury Trial. You and Lifelogging.AI waive any right to a jury trial in any action or proceeding arising out of or relating to these terms of service.
Class Action Waiver. You and Lifelogging.AI agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and Lifelogging.AI agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims, and may not otherwise preside over any form of a representative or class proceeding.
Governing Law. These Terms of Service and any Dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction).
Severability. If any provision of this Dispute Resolution section is found to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page.
