By accessing and using Lifelogging.AI (the Application), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use this service.

The Application provides AI-generated insights based on user-submitted journal entries. These insights are provided "as-is" and are not guaranteed to be accurate, complete, or reliable. The Company is not liable for any decisions, actions, or consequences resulting from the use of these AI-generated insights. We do not assume liability for inaccuracies or errors in the AI analysis or for any loss or damage of any kind incurred as a result of the use of our service.

Users agree to indemnify and hold harmless the Company and its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Application, your violation of the Terms, or your violation of any rights of another.

The Company reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We are not liable to users or any third party for any modification, price change, suspension, or discontinuance of the service.

9. Dispute Resolution

Mediation. In the event of any dispute, claim, or controversy arising out of or relating to these Terms of Service, or the breach, termination, enforcement, interpretation, or validity thereof ("Dispute"), you and the Company agree to first attempt to resolve the Dispute through mediation.

Mediation Process. The mediation will be conducted in San Jose, California by a mediator chosen by the parties or, if the parties cannot agree, appointed by the American Arbitration Association ("AAA"). The mediation will be conducted in accordance with the AAA's Commercial Mediation Procedures. The costs of mediation will be paid by the party raising the dispute.

Arbitration. If the Dispute is not resolved through mediation within [30] days of the commencement of mediation, or if either party refuses to participate in mediation, the Dispute will be resolved by binding arbitration in accordance with the AAA's Commercial Arbitration Rules. The arbitration will be conducted in [City, State] before a single arbitrator appointed in accordance with the AAA's rules. The arbitrator's decision will be final and binding on the parties, and judgment on the award may be entered in any court of competent jurisdiction.

Waiver of Jury Trial. You and the company waive any right to a jury trial in any action or proceeding arising out of or relating to these terms of service.

Class Action Waiver. You and the company agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and the Company agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims, and may not otherwise preside over any form of a representative or class proceeding.

Governing Law. These Terms of Service and any Dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction).

Severability. If any provision of this Dispute Resolution section is found to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
